1. Introduction

Welcome to CyprusDevOps. These Terms of Service ("Terms") govern your use of our website, services, and learning platform (collectively, the "Services") operated by CyprusDevOps ("we," "us," or "our"). By accessing or using our Services, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our Services.

2. Acceptance of Terms

By accessing or using the Services, you acknowledge that you have read, understood, and agree to be bound by these Terms. These Terms constitute a legal agreement between you and CyprusDevOps. If you are using the Services on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these Terms.

CyprusDevOps provides professional training and education services in the field of DevOps, cloud infrastructure, and related technologies. Our Services include, but are not limited to:

  • In-person and online training courses
  • Educational content and materials
  • Learning management system access
  • Certification programs
  • Mentoring and coaching services

We reserve the right to modify, suspend, or discontinue any aspect of our Services at any time without prior notice.

4. User Accounts and Registration

Some portions of our Services require you to create an account. When registering for an account, you agree to provide accurate, current, and complete information. You are solely responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

We reserve the right to disable your account at any time if we believe you have violated these Terms or if we determine that your account activity poses a risk to our Services or other users.

5. Intellectual Property Rights

All content, materials, and resources provided through our Services, including but not limited to text, graphics, logos, icons, images, audio clips, digital downloads, data compilations, software, and course materials, are the property of CyprusDevOps or our content suppliers and are protected by copyright, trademark, and other intellectual property laws.

Upon enrolling in a course or accessing our Services, we grant you a limited, non-exclusive, non-transferable license to use the materials for your personal, non-commercial educational purposes. You may not:

  • Copy, reproduce, modify, or create derivative works of the materials
  • Distribute, publicly display, publicly perform, or publish any content
  • Use the materials for any commercial purpose, or for any public display
  • Remove any copyright or other proprietary notations from the materials
  • Transfer the materials to another person or "mirror" the materials on any other server

This license shall automatically terminate if you violate any of these restrictions and may be terminated by CyprusDevOps at any time.

6. Prohibited Activities

You agree not to engage in any of the following prohibited activities:

  1. Using the Services for any unlawful purpose or in violation of any applicable regulations
  2. Impersonating any person or entity or falsely stating your affiliation with a person or entity
  3. Interfering with or disrupting the Services or servers or networks connected to the Services
  4. Attempting to gain unauthorized access to any portion of the Services or any other systems or networks
  5. Using any robot, spider, site search/retrieval application, or other automated device to retrieve or index any portion of the Services
  6. Collecting or harvesting information about other users without their consent
  7. Uploading or transmitting viruses, malware, or other malicious code
  8. Sharing your account credentials or allowing others to access your account
  9. Reselling, duplicating, or otherwise exploiting the course materials or Services for commercial purposes

7. Content Guidelines

Our Services may allow you to post, submit, or share content such as comments, feedback, or submissions in discussion forums. You retain ownership of any content you submit, but you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, adapt, publish, translate, and distribute such content in connection with our Services.

You are solely responsible for any content you post, and you agree that your content will not:

  • Infringe on the intellectual property rights of any party
  • Contain any material that is defamatory, obscene, harassing, threatening, or otherwise objectionable
  • Include personal or identifying information about another person without their explicit consent
  • Advertise or promote third-party products or services
  • Contain any malicious code, files, or programs

We reserve the right to review, remove, or modify any content that violates these guidelines or is otherwise objectionable at our sole discretion.

8. Payment Terms

By enrolling in our courses or purchasing our Services, you agree to pay all fees associated with your selection. All fees are quoted in euros (€) and are subject to change. We accept payment through the methods specified on our website.

Fee schedules, refund policies, and payment terms for specific courses or services will be provided at the time of enrollment or purchase. By proceeding with payment, you agree to the specific terms applicable to your purchase.

Refund requests will be handled according to our refund policy, which may vary by course or service. Generally, refund requests must be submitted within 14 days of purchase for courses that have not yet commenced or within 7 days after the start date if you have accessed less than 20% of the course materials.

9. Limitation of Liability

To the maximum extent permitted by applicable law, CyprusDevOps and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:

  1. Your access to or use of or inability to access or use the Services
  2. Any conduct or content of any third party on the Services
  3. Any unauthorized access, use, or alteration of your transmissions or content
  4. Any errors or omissions in the technical operation of the Services

In no event shall our total liability to you for all claims exceed the amount paid by you, if any, for accessing or using our Services during the twelve (12) months preceding the claim.

10. Warranty Disclaimer

The Services are provided on an "as is" and "as available" basis without any warranty or representation, express or implied. CyprusDevOps does not warrant that the Services will be uninterrupted, timely, secure, or error-free, or that defects will be corrected. We do not guarantee that any specific results will be obtained from the use of our Services.

To the fullest extent permitted by law, we disclaim all warranties, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

11. Indemnification

You agree to indemnify, defend, and hold harmless CyprusDevOps and its officers, directors, employees, agents, licensors, and suppliers from and against all losses, expenses, damages, and costs, including reasonable attorneys' fees, resulting from any violation of these Terms or any activity related to your account (including negligent or wrongful conduct) by you or any other person accessing the Services using your account.

12. Modifications to Terms

We reserve the right to modify these Terms at any time. We will provide notice of material changes by posting the updated Terms on our website and updating the "Last Updated" date. Your continued use of the Services after such changes constitutes your acceptance of the revised Terms.

It is your responsibility to review the Terms periodically to stay informed of updates. Material changes will not apply retroactively and will become effective no sooner than fourteen (14) days after they are posted.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Republic of Cyprus, without regard to its conflict of law provisions. You agree to submit to the personal and exclusive jurisdiction of the courts located within Cyprus for the resolution of any disputes arising out of or relating to these Terms or your use of the Services.

14. Termination

We may terminate or suspend your access to the Services immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms. Upon termination, your right to use the Services will immediately cease.

All provisions of the Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

15. Miscellaneous

Entire Agreement: These Terms constitute the entire agreement between you and CyprusDevOps regarding the Services and supersede all prior and contemporaneous agreements, proposals, or representations, written or oral, concerning their subject matter.

Waiver: No waiver of any breach of any provision of these Terms shall constitute a waiver of any prior, concurrent, or subsequent breach of the same or any other provisions, and no waiver shall be effective unless made in writing and signed by an authorized representative of the waiving party.

Severability: If any provision of these Terms is held to be unlawful, void, or for any reason unenforceable, then that provision shall be deemed severable from these Terms and shall not affect the validity and enforceability of any remaining provisions.

Assignment: You may not assign or transfer these Terms, by operation of law or otherwise, without our prior written consent. Any attempt to assign or transfer these Terms without such consent will be null and void.

Force Majeure: We will not be liable for any delay or failure to perform any obligation under these Terms where the delay or failure results from any cause beyond our reasonable control, including acts of God, labor disputes, or other industrial disturbances, systemic electrical, telecommunications, or other utility failures, pandemic, earthquake, storms or other natural events, blockages, embargoes, riots, acts or orders of government, acts of terrorism, or war.
